Below are the details of the terms and conditions of the booking agreement. Please read them carefully. You warrant that the information given by you on the booking form is complete and true. A contract will exist as soon as we issue our confirmation invoice. Note that we will not issue a confirmation invoice, and therefore no contract will exist, until we receive a fully-completed booking form for each and every member of any party. This contract is made on the terms of these booking conditions; any disputes arising from this contract are to be decided by the Croatian courts.
We provide full financial protection for our package holidays through insurance obtained by leading and oldest Croatian insurance company Croatia Osiguranje (attach certificate 1). We reserve the right to alter the prices of any of the holidays shown in our brochure and/or on our website. You will be advised of the current price of the holiday that you wish to book before your contract is confirmed. However there will be no change within 30 days of your departure. Unless otherwise stated, all group tours are guaranteed to operate once a minimum group size is reached.
It is in the nature of a holiday of this kind that arrangements and participants have to be flexible. The day-to-day agenda and ultimate goal of the trip are taken as aims and not as contractual obligations. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor (change of the hotel with another hotel of same category, daily agenda due to weather conditions, or similar). We also reserve the right in any circumstances to cancel your travel arrangements. For example, if the minimum number of clients required for a particular travel arrangement is not reached, we may have to cancel your trip. However, we will not cancel your travel arrangements less than 4 weeks before your departure date, except for reasons of failure by you to pay the final balance or force majeure (natural disaster, fire, adverse weather conditions or other unforeseen circumstances). If we are unable to provide the booked travel arrangements, you can either have a refund of all monies paid or accept an offer of alternative travel arrangements. If, for an unforeseeable reason outside of our control, we have to cut short your holiday, no refund or compensation will be made for any unused service or feature of the trip. We reserve the right to return your deposit and decline to issue a confirmation at our absolute discretion.
If the contract we have with you is not performed or is improperly performed by us we will be liable in accordance with two separate insurance policies we have with Croatia Osiguranje (attach certificate 2). However, we will not be liable where any failure in the performance of the contract is due to: you; or a third party unconnected with the provision of the travel arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised. We will offer you such prompt assistance as is reasonable in the circumstances. Our liability, except in cases involving death, injury or illness, shall be limited to a maximum of two times the cost of your travel arrangements. Please note that dates, itineraries and prices are indicative only and you must contact us for the up to date information. Prices quoted are based on “twin shared” accommodation, and may be subject to change without notice. A supplement may be charged for single room occupancy, as detailed in the tour information on our website.
We take full responsibility for ensuring that proper security measures are in place to protect your information. The information may also be provided to public authorities such as customs or immigration if required by them, or as required by law.
When you make your booking you must pay a non-refundable deposit of €250 per person for the travel arrangements. The applicable deposit is listed on our website and will be confirmed at the time of booking. Upon receipt of your booking, we will forward a confirmation invoice informing you of the date by which final payment must be made for your trip. This is normally 8 weeks before departure. In the case of non-payment of the balance by the due date, we reserve the right to cancel your booking and cancellation charges will apply. An administration fee of up to €60, plus any further costs incurred, will be charged if you wish to make changes to your travel arrangements. Any request for changes must be made in writing from the person who made the booking. You should be aware that costs incurred in changing a booking could increase the closer to the departure date they are made and you should therefore contact us as soon as possible. You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking must be received at our office. We strongly recommended that full insurance is taken out, which includes cover, against the loss of deposit or cancellation charges. If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.
Your booking is accepted on the understanding that you realize and accept the risks and hazards potentially involved in biking / hiking activities and that you are mentally and physically fit. For our trips the minimum age is 18 years. In exceptional circumstance we may allow children between 12 and 18 years-old, accompanied by a responsible adult, to join one of our tours. For our trips we have no upper age limit though we remind you that our trips can be physically demanding. All guests staying with us are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of other guests. In case your behavior causes danger or annoyance to any of our other guests or any third party or damage to property, we reserve the right to terminate your booking arrangements with us immediately. You are responsible for bringing with you the proper clothing and equipment, which we advise you about in our printed trip information and pre-departure information pack. We do not provide bikes or other cycling equipment. However we do offer the option to hire bikes and other cycling equipment for the duration of the trip. Your specific passport and visa requirements, and other immigration requirements are your responsibility. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements.
Adequate insurance for the complete duration of your trip is absolute must. It is your responsibility to ensure that the insurance cover you purchase is adequate for the particular needs of you and your party. We do not check insurance policies. Baggage and personal effects, including bikes, are at all times at your own risk. We will not be responsible for any loss, damage or accident to any luggage and property, howsoever incurred. You are advised to check the limitations of your insurance policy in this respect.
